Members of the board serve without compensation but are entitled to reimbursement for actual expenses incurred in attending board meetings and in performing the duties of a board member.
The governor may transfer to any division personnel, equipment, records, obligations, appropriations, functions, and duties of appropriate divisions of the governor's office. For purposes of this chapter, a grant includes a forgivable loan. September 28, The term includes: A buildings, structures, land, equipment, facilities, or other real or personal properties that are necessary, convenient, or desirable appurtenances, including streets, water, sewers, utilities, parks, site preparation, landscaping, stores, offices, and other nonhousing facilities, such as administrative, community, and recreational facilities the department determines to be necessary, convenient, buildesr desirable appurtenances; and B single and multifamily dwellings in rural and urban areas.
A proceeding to impose the penalty is considered to be a contested case under Chapter The presiding officer shall then notify the governor and the attorney general that a potential ground for removal exists. The director shall monitor the compliance of employees with those requirements. All merit pay for department employees must be based on the system established under this section. The board shall set the salary of the director.
September 1, Members of the board hold office for staggered terms of six years, with the terms of two or three members expiring on January 31 of each odd-ed year.
Not later than the 30th day after the date the board's order becomes final, the person shall: 1 pay the penalty; or 2 file a petition for judicial review contesting the occurrence of the violation, the amount of the penalty, or both. The director or the director's deee shall become aware of and provide to members of the board and to department employees, as often as necessary, information regarding the requirements for office or employment under this chapter, including information regarding a person's responsibilities under applicable laws relating to standards of conduct for state officers or employees.
The policy statement must include: 1 a comprehensive analysis of the department work force that meets federal and state guidelines; 2 personnel policies, including policies relating to recruitment, evaluation, selection, appointment, training, and promotion of personnel; 3 procedures by which a determination can be made of adullt underuse in the department work force of all persons for whom federal or state guidelines encourage a more equitable balance; natch 4 reasonable methods to appropriately address those areas of ificant underuse.
In this chapter: 1 "Board" means the governing board of the department. The duties imposed and activities authorized by this chapter serve public purposes, and public money may be borrowed, spent, advanced, loaned, granted, or appropriated for those purposes. The department shall post the transcripts on its website and shall otherwise maintain all s, minutes, and other records Ibdian to the meetings.

A director deated under this section serves at the pleasure of the board but is subject to removal by a newly elected governor in accordance with Section The file must frkm 1 the name of the person who filed the complaint; 2 the date the complaint is received by the department; 3 the subject matter of the complaint; 4 the name of each person contacted in relation to the complaint; 5 a summary of the of the review or investigation of the complaint; and 6 an explanation of the reason the file was closed, if the department closed the file without taking action other than to investigate the complaint.
Trustee-held funds of the department under a multifamily bond indenture are held by the trustee as provided by the indenture.
Added by Acts73rd Leg. On request, the department shall participate in any public hearing conducted by a legislator to discuss a rule to be adopted by the department. The presiding officer presides at meetings of the board and performs other duties required by this chapter.
The director or the director's deee shall develop a system of annual performance evaluations. Added by Acts77th Leg. The board shall develop and implement policies that clearly separate the policy-making responsibilities of the board and the management responsibilities of the director and staff of the department.

September 28, Except as specifically provided by this chapter, the department is subject to the General Appropriations Act. Appointments to the board must broadly reflect the geographic, economic, cultural, and social diversity of the state, including ethnic minorities, persons with disabilities, and women.
A buildsrs appointed to the board must be a registered voter in the state and may not hold another public office. An individual may not, because of that individual's race, color, national origin, or sex, be excluded from participation, be denied benefits, or be subjected to discrimination in any program or activity funded in whole or in part with funds made available under this chapter.
The department, at least quarterly until final disposition of the complaint, shall notify the person filing the complaint matcn each person who is a subject of the complaint of the status of the investigation unless the notice would jeopardize an undercover investigation.
